Cancellation policy

YOUR RIGHT TO CANCEL

This cancellation policy applies between the customer and Everleigh Dynamic Eco Limited – Trading As Dynamic Heaters.

This cancellation policy should be read alongside, and in addition to, our Terms and Conditions, which can be found on all quotes, invoices and further terms and conditions at: https://www.dynamicheaters.co.uk/terms-and-conditions/ .

1 The Consumer Contracts (Information, Cancellation and Additional Charges)

1.1 All orders are subject to a 14 days cooling off period. In which time the customer has the right to cancel the order in full with a full refund of any deposits paid to date. The cooling off period starts from the date the order is delivered, all orders to be placed in writing and/or acceptance of the contract through payment of deposit. An email in this case is deemed as “in writing”.

1.2 After the 14 days cooling off period, a 10% cancellation fee of the total order value will be payable to “Everleigh Dynamic Eco Limited – Trading As Dynamic Heaters”. In most cases this will be deducted from the deposit refund. This has been deemed as a fair and reasonable cost to cover loss of earnings suffered by “Everleigh Dynamic Eco Limited – Trading As Dynamic Heaters”.

• Refunded deposits to be repaid within 10 working days.

1.3 All cancellations must be made in writing. An email in this case is deemed as “in writing”.

2. Exclusion from the right to cancel (made-to-order & custom colours)

2.1 Bespoke and Customised Goods Exemption
In accordance with Regulation 28(1)(c) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the statutory 14-day cooling-off period and right to cancel do not apply to any goods that are made to your unique specifications or are clearly personalised.

2.2 Application to Specific RAL Colours
Where you place an order for products to be manufactured, finished, or coated in a specific RAL colour selected by you, these items are deemed “made-to-order” and highly custom. The production process for these custom colours begins immediately upon contract conclusion or payment confirmation.

2.3 No Right to Cancel or Return
Once an order for a specific RAL colour product has been placed and accepted by us, you acknowledge and agree that:

• You do not have a statutory right to cancel the order.
• You will not be entitled to a 14-day cooling-off period.
• We cannot accept returns, modifications, or exchanges for these items unless they arrive damaged, defective, or do not match the specific RAL colour code stated on your order confirmation.

Please ensure that you have double-checked all measurements, technical specifications, and the exact RAL colour code before finalising your purchase, as mistakes cannot be rectified once production has commenced.

3. Law and Jurisdiction

3.1 This Agreement shall be governed by the laws of England and Wales.

3.2 Any dispute between the Parties relating to this Agreement shall fall within the jurisdiction of the courts of England and Wales.
